However you could really screw the already screwed financial pooch if you don't follow the correct procedure.

At least consult an on-line legal service for exact steps...some of the laws have changed.</description>

It depends on a lot  of factors.  First, attorneys cost  more in some areas than other areas.  Also, how  complicated  is your case?  These are things you need  to keep in mind.

First, why do you want to file Chapterr  13?  If you  can qualify for  Chapter 7 than file  for Chapter 7.  (Under Chapter 7 most of your debts are discharged.  Debts for  student loans,  child support, court fines and taxes generally cannot  be discharged  in  bankruptcy.)

Speak with a lawyer, because you may qualify  for Chapter 7 even if you think you don't.  Only a good  lawyer  can make  this  determination.

If you file Chapt. 13 you will be put on a payment plan  and you will  still have  to repay some of your debts.  Any time you pay less than you owe on a debt it hurts your  credit.  If you have bad credit you might  as well file for Chapter 7.

You can always represent  yourself in court.  It's a bad idea, but you can do it.  I would hire a good lawyer.  Call around because the prices vary dramatically.  You want a lawyer  who specializes in bankruptcy.  Avoid the general  practioner who only occassionally represents a client in bankruptcy court. 

I filed for  Chapter 7 in Albuquerque, New Mexico about  nine months ago and I paid my attorney $1,200, which covered everything.   I had a great lawyer.
